Estos términos son el acuerdo entre tú y Juan Miguel Ovalle, quien desarrolla y opera Hotaru («Hotaru», «nosotros»), para usar la app Hotaru y sus servicios. Al usar la app o crear una cuenta los aceptas. Si no estás de acuerdo, no uses la app. Cómo tratamos tus datos está en la Política de privacidad.

1. Qué es Hotaru

Hotaru es una app para estudiar japonés con tarjetas y repetición espaciada. Puedes usarla sin cuenta; crear una cuenta es opcional y sirve para sincronizar tu estudio entre dispositivos. Hotaru es una herramienta de estudio: no garantiza ningún resultado, por ejemplo aprobar un examen JLPT.

2. Tu cuenta

• Para crear una cuenta debes tener al menos 14 años. Si en tu país eres menor de edad, necesitas el permiso de tu madre, padre o tutor.
• La cuenta se crea con Google o con Apple. Cuidar el acceso a esa cuenta es tu responsabilidad.
• Puedes borrar tu cuenta cuando quieras desde la app, en Perfil → Cuenta → Eliminar cuenta, o como explica esta página.

3. Hotaru Premium

Algunas funciones son parte de Hotaru Premium. Hoy se obtiene con un pago único, la «Founder's Edition». Más adelante podríamos ofrecerlo también como suscripción.

• La compra y el cobro los hace Google Play o la App Store, con la cuenta de esa tienda, y se rigen también por sus condiciones. Nosotros no vemos ni guardamos tus datos de pago. El precio se muestra antes de comprar.
• El pago único se paga una vez y no se renueva. Incluye las funciones premium que tenga Hotaru, también las que se agreguen después, sin cobros adicionales por ellas.
• «Para siempre» significa mientras Hotaru siga funcionando. Si algún día cerráramos el servicio, lo avisaremos con anticipación razonable, y la app instalada seguirá funcionando en tu dispositivo con lo que no dependa de nuestros servidores.
• La compra queda en tu cuenta de la tienda: en otro dispositivo con la misma cuenta se recupera desde Perfil → Restaurar compra. Si inicias sesión en Hotaru, también queda asociada a tu cuenta.
• Los reembolsos los decide cada tienda según sus políticas y la ley de tu país. Una compra reembolsada deja de dar acceso a las funciones de pago.
• Si dejas de tener Premium pierdes el acceso a las funciones de pago, pero no tu estudio: tus mazos, tarjetas y progreso se conservan, y lo que hayas configurado vuelve si lo recuperas.

Si en el futuro contratas una suscripción:

• Se renueva automáticamente al final de cada período, al precio vigente, salvo que la canceles al menos 24 horas antes de que termine. El precio y el período se muestran antes de comprar.
• Se cancela desde la tienda: en Google Play, Pagos y suscripciones → Suscripciones; en iPhone, Ajustes → tu nombre → Suscripciones. Borrar la app o la cuenta no cancela la suscripción.
• Si hay un período de prueba gratis y no cancelas antes de que termine, se cobra el primer período.
• Si cambia el precio, te avisaremos con anticipación, como exija la tienda, y podrás cancelar antes de que se aplique.

4. Tu contenido

Los mazos, tarjetas, audios e imágenes que creas o importas son tuyos. Solo nos das permiso para guardarlos, copiarlos entre tus dispositivos y respaldarlos, y únicamente para darte el servicio.

Eres responsable de tener derecho a usar lo que importas, por ejemplo un mazo de Anki hecho por otra persona. No subas contenido ilegal ni que infrinja derechos de otros. Si recibimos un aviso fundado de que un contenido infringe derechos, podemos quitarlo de nuestros servidores.

5. El contenido de Hotaru

Los mazos que publica Hotaru (sus palabras, oraciones, significados, audios e imágenes) y la app misma son de Hotaru o de quienes nos dan licencia. Te damos una licencia personal, no exclusiva e intransferible para usarlos en la app mientras estudias. No puedes copiarlos, extraerlos en masa, venderlos ni publicarlos por otros medios. Las fuentes de terceros y sus licencias están en Perfil → Ayuda y acerca de → Créditos.

6. Uso aceptable

No está permitido:

• Intentar acceder a cuentas o datos de otras personas.
• Atacar, sobrecargar o intentar vulnerar nuestros servidores.
• Descompilar la app o saltarse sus restricciones de pago, salvo lo que la ley permita expresamente.
• Usar el servicio para algo ilegal.

Si alguien lo hace, podemos suspender o cerrar su cuenta. Salvo que sea urgente o ilegal avisar, lo diremos antes y explicaremos por qué.

7. Disponibilidad

Hacemos lo posible por que Hotaru funcione siempre, pero el servicio puede interrumpirse por mantenimiento, fallas o causas fuera de nuestro control, y sus funciones pueden cambiar con el tiempo. La app guarda tu estudio en el dispositivo, así que puedes seguir estudiando sin conexión.

8. Responsabilidad

Hotaru se ofrece tal como está. En la medida en que la ley lo permita, no respondemos por daños indirectos ni por la pérdida de datos que no hayas sincronizado. Nada de esto limita los derechos que te da la ley como consumidor, que no se pueden renunciar.

9. Cambios a estos términos

Si los cambiamos, actualizaremos esta página y su fecha. Si el cambio te afecta de forma importante, te avisaremos en la app antes de que rija. Seguir usando Hotaru después significa que aceptas los nuevos términos; si no, puedes dejar de usarla y borrar tu cuenta.

10. Ley aplicable y contacto

Estos términos se rigen por las leyes de Chile. Si vives en otro país, conservas las protecciones que te da la ley de consumo de tu país.

These terms are the agreement between you and Juan Miguel Ovalle, who develops and runs Hotaru ("Hotaru", "we"), for using the Hotaru app and its services. By using the app or creating an account you accept them. If you don't agree, don't use the app. How we handle your data is in the Privacy policy.

1. What Hotaru is

Hotaru is an app for studying Japanese with flashcards and spaced repetition. You can use it without an account; an account is optional and syncs your study across devices. Hotaru is a study tool: it doesn't guarantee any result, such as passing a JLPT exam.

2. Your account

• You must be at least 14 to create an account. If you are a minor where you live, you need permission from a parent or guardian.
• Accounts are created with Google or Apple. Keeping that account secure is your responsibility.
• You can delete your account at any time in the app, under Profile → Account → Delete account, or as described on this page.

3. Hotaru Premium

Some features are part of Hotaru Premium. Today it comes with a one-time purchase, the "Founder's Edition". Later we may also offer it as a subscription.

• The purchase and billing are handled by Google Play or the App Store, with your store account, and are also governed by their terms. We never see or store your payment details. The price is shown before you buy.
• The one-time purchase is paid once and doesn't renew. It includes Hotaru's premium features, including those added later, at no extra charge for them.
• "Forever" means for as long as Hotaru keeps running. If we ever shut the service down, we will give reasonable notice, and the app installed on your device will keep working with whatever doesn't depend on our servers.
• The purchase belongs to your store account: on another device with the same account, get it back under Profile → Restore purchase. If you sign in to Hotaru, it is also linked to your account.
• Refunds are decided by each store under its policies and the law where you live. A refunded purchase no longer gives access to the paid features.
• If you stop having Premium you lose access to the paid features, but not your study: your decks, cards and progress are kept, and your settings come back if you get it again.

If you take out a subscription in the future:

• It renews automatically at the end of each period, at the current price, unless you cancel at least 24 hours before it ends. The price and period are shown before you buy.
• You cancel from the store: on Google Play, Payments & subscriptions → Subscriptions; on iPhone, Settings → your name → Subscriptions. Deleting the app or your account does not cancel the subscription.
• If there is a free trial and you don't cancel before it ends, the first period is charged.
• If the price changes, we will tell you in advance, as the store requires, and you can cancel before it applies.

4. Your content

The decks, cards, audio and images you create or import are yours. You only allow us to store them, copy them between your devices and back them up, solely to provide the service to you.

You are responsible for having the right to use what you import, for example an Anki deck made by someone else. Don't upload content that is illegal or infringes other people's rights. If we receive a well-founded notice that content infringes rights, we may remove it from our servers.

5. Hotaru's content

The decks Hotaru publishes (their words, sentences, meanings, audio and images) and the app itself belong to Hotaru or to those who license them to us. We give you a personal, non-exclusive, non-transferable licence to use them in the app while you study. You may not copy them, extract them in bulk, sell them or publish them elsewhere. Third-party sources and their licences are listed under Profile → Help and about → Credits.

6. Acceptable use

You may not:

• Try to access other people's accounts or data.
• Attack, overload or try to break into our servers.
• Decompile the app or get around its payment restrictions, except as the law expressly allows.
• Use the service for anything illegal.

If someone does, we may suspend or close their account. Unless it is urgent or unlawful to warn them, we will say so first and explain why.

7. Availability

We do our best to keep Hotaru running, but the service may be interrupted for maintenance, failures or reasons beyond our control, and its features may change over time. The app keeps your study on the device, so you can keep studying offline.

8. Liability

Hotaru is provided as is. To the extent the law allows, we are not liable for indirect damages or for the loss of data you had not synced. None of this limits the rights you have by law as a consumer, which cannot be waived.

9. Changes to these terms

If we change them, we will update this page and its date. If a change affects you significantly, we will tell you in the app before it takes effect. Continuing to use Hotaru afterwards means you accept the new terms; if you don't, you can stop using it and delete your account.

10. Governing law and contact

These terms are governed by the laws of Chile. If you live in another country, you keep the protections your country's consumer law gives you.
